Is Kratom Legal in South Carolina?

Chief Smoke 'n Brew

It isn’t uncommon for state and local lawmakers to threaten new regulations on kratom, so we like to update our customers on kratom’s legal status every once in a while. The FDA has considered a crackdown on the sale of kratom for some time, but hasn’t pulled the trigger on a national ban. However, some states like Michigan are considering legislation that would require kratom users get a prescription, and some municipalities are banning the sale of kratom outright.

What is Kratom’s Legal Status in South Carolina?

As of this writing in October 2019, yes. Kratom is legal in South Carolina. There are currently no state, county, or city restrictions on the sale or use of kratom in the Palmetto State. As of now, there is no legislation under consideration that would put any restrictions on kratom use in the state. For now, it looks like we’re in the clear.

What is Kratom?

Kratom is the common name for Mitragyna speciosa, a tropical tree native to Southeast Asia. It is a member of the Rubiaceae family, a family of flowering plants that also includes coffee. Plants can grow up to 85 feet tall, depending on the climate and growing conditions. It has massive green leaves, which are the source of commercial kratom.

The leaves almost always are dried and powdered before sale. This powder has been used in traditional medicine practices in its native region for centuries, and has grown in popularity in the United States in recent years. Kratom powder is often sold in capsules to provide an easy method of measurement.

Kratom in the USA

The United States Drug Enforcement has stated that there is “no legitimate medical use for kratom,” and the FDA has not approved kratom for human consumption. While both organizations are reluctant to approve kratom for any use, they also have not made good on any threats to ban the substance outright.

Kratom has been the subject of a number of animal studies on its physiological effects. Some of these studies have produced promising results, and other studies are under way. However, there has never been a US-based clinical trial focused on kratom, and researchers are still a long way out from a scientific consensus on using kratom.
